Setting up a company in Ireland is just one step in the process of using Ireland as a gateway to Europe.

All Irish companies are required to have at least one director who is a resident of an EEA country to comply with company law.

If all of your directors live outside of the EEA you need to put in place a Section 137 Revenue Bond or prove a Real & Continuous Link to Ireland.

In reality in order to be able to apply for certification of a Real & Continuous Link to Ireland the company would need to show that the company has a person working from a location in Ireland managing the business and/or it carries on a trade in Ireland. Newly formed companies are unlikely to prove this link and should at least have Irish based employees prior to applying

It is important to note that the Real & Continuous Link to Ireland requires Revenue approval. You apply to the Irish Revenue to obtain an opinion from them that a link exists.

Once this has been approved you must complete a Form B67 submission, attaching the confirmation from Revenue, to the Registrar of Companies.

You should speak to your accountant if you are unsure if you would qualify for the above and how to apply.
